Plain Summary
CelebrateSync and HostHaven provide event-management, guest-experience, supplier-information, media, communication, and related digital tools.
For most Event Data, the Event Organizer decides what information is collected and how it is used for the Event. CelebrateSync provides the technology platform and may process that Event Data on the Organizer’s behalf.
CelebrateSync also processes certain information for its own platform purposes, including account management, security, customer support, billing for platform fees, legal compliance, abuse prevention, and product operation.
Private Event media is not sold or used for public advertising without appropriate authorization. Supplier payments, escrow, marketplace checkout, supplier payouts, targeted ads, paid Spark Points, facial recognition, and AI decisioning are not enabled unless separately reviewed and released.

(c) applicable Event-specific rules, notices, and requirements;

The foregoing documents are collectively referred to as the “Governing Documents.”
The User is expected to review the Governing Documents before accessing or using the Services. The current versions will be made reasonably accessible through the application, website, or other appropriate interface.
4. ACCEPTANCE
The User's acceptance of this Agreement constitutes the User's single acknowledgment and acceptance of the Governing Documents applicable to the User. By selecting “I AGREE AND CONTINUE,” the User confirms that the User has been provided reasonable access to the Governing Documents and agrees to comply with them in connection with the User's access to and use of CelebrateSync. The User understands that the Governing Documents may contain separate provisions concerning accounts, Events, payments, Content, intellectual property, privacy, data protection, security, prohibited conduct, suppliers, reviews, Event participation, dispute resolution, termination, and other matters relevant to the Services. The User's acceptance is intended to constitute one unified acceptance of the applicable contractual and policy framework rather than requiring a separate acceptance for each document.
5. PRIVACY NOTICE ACKNOWLEDGMENT
By accepting this Agreement, the User acknowledges that the User has been provided reasonable access to the CelebrateSync Privacy Notice and Data Rights Policy. The User understands that the Privacy Notice explains how CelebrateSync may collect, receive, use, store, organize, retrieve, disclose, transfer, protect, retain, delete, and otherwise process personal data in connection with the Services. The User further understands that the Privacy Notice explains the circumstances in which CelebrateSync may act as a Personal Information Controller (“PIC”) or Personal Information Processor (“PIP”), including circumstances in which an Event Organizer determines the purposes and means of processing Event Data. The User acknowledges that the Privacy Notice forms part of the privacy framework applicable to the Services.
6. ACKNOWLEDGMENT OF PROCESSING AND CONSENT WHERE REQUIRED
By accepting this Agreement, the User acknowledges that CelebrateSync may process personal data as described in the Privacy Notice and other applicable Governing Documents for the purposes of providing, administering, maintaining, securing, supporting, and improving the Services.
The User understands that different processing activities may rely on different lawful bases under applicable law. Some processing may be necessary to provide the requested Service, perform a contract, maintain security, prevent fraud or abuse, comply with legal obligations, respond to lawful requests, establish or defend legal claims, or protect lawful rights and interests. Other processing may require the User’s consent.
Where consent is the applicable lawful basis for a specific processing activity, the User consents only to the processing that has been specifically described, presented, and requested through the applicable consent mechanism. Such consent applies only to the identified purpose, data category, and processing activity, and does not operate as blanket consent for unrelated, optional, future, or undisclosed processing.
The categories of information that may be processed are described in the Privacy Notice and may include, where applicable, Account information, contact information, Event information, RSVP and attendance information, Event Credentials, User Content, photographs and videos, communications, technical and device information, usage information, security information, and other information reasonably necessary for the Services actually used.
The User understands that the specific information processed will depend on the Services, features, permissions, Events, roles, and settings actually used.
7. OTHER LAWFUL BASES FOR PROCESSING
The User understands and acknowledges that not all processing of personal data is necessarily based upon consent. Depending upon the circumstances, CelebrateSync may process personal data because the processing is necessary to perform a contract, comply with a legal obligation, protect legitimate rights and interests, maintain security, prevent fraud or abuse, respond to lawful requests, establish or defend legal claims, or because another lawful basis is recognized under applicable law. Accordingly, the User's withdrawal of consent will not necessarily require CelebrateSync to stop all processing of personal data. Where CelebrateSync has another lawful basis for processing, that processing may continue notwithstanding the withdrawal of consent, subject to applicable law.
8. EVENT DATA
The User understands that CelebrateSync may process personal data in connection with Events created, organized, or administered through the Services. An Event Organizer may determine what information is collected from guests, why the information is required, who may access it, and how it is used for the Event. Where the Event Organizer determines the purposes and means of processing Event Data, the Organizer may act as the PIC and CelebrateSync may act as the PIP. By accepting this Agreement, the User acknowledges that information provided in connection with an Event may be processed by CelebrateSync and by the applicable Event Organizer and authorized Event personnel for legitimate Event-related purposes. The User understands that the Organizer may have additional privacy responsibilities and may provide separate notices concerning Event Data.
9. USER CONTENT AND EVENT MEDIA
The User acknowledges that CelebrateSync may process photographs, videos, audio recordings, reviews, ratings, comments, Event memories, captions, documents, and other Content that the User uploads or submits through the Services. By accepting this Agreement, the User authorizes CelebrateSync to process such Content to the extent reasonably necessary to host, store, transmit, display, format, secure, moderate, maintain, and provide the functionality for which the Content was submitted. This authorization does not grant CelebrateSync unlimited ownership of the User's Content. Ownership and other rights in User Content remain subject to the Terms of Service and applicable law. The User understands that Content intentionally submitted through a public-facing feature may become accessible to persons beyond the User's immediate Event or Account.
10. APPLICATION AND DEVICE PERMISSIONS
The User acknowledges that certain CelebrateSync features may require access to device functions such as the camera, photographs or media library, notifications, microphone, location, contacts, storage, or other device capabilities. Where a device-level permission is required, the User may be asked by the application or operating system to authorize that permission. The User understands that granting a device permission allows the relevant feature to function but does not constitute authorization for unrelated use of information. The User may manage applicable device permissions through the User's device settings, subject to the technical requirements of the relevant feature.
11. THIRD-PARTY SERVICE PROVIDERS
The User acknowledges that CelebrateSync may engage third-party service providers to support the operation of the Services. These may include hosting, cloud infrastructure, storage, authentication, messaging, email, notifications, cybersecurity, analytics, monitoring, customer support, backup, content delivery, and other technical or professional service providers. Where appropriate, such providers may process personal data on behalf of CelebrateSync and will be subject to applicable contractual, confidentiality, security, and data-protection requirements. The User acknowledges that certain third-party services may independently process information under their own privacy notices and terms where they act as independent controllers.
12. CROSS-BORDER PROCESSING
The User acknowledges that certain Service providers or technical infrastructure used by CelebrateSync may be located outside the Philippines. Personal data may therefore be stored, accessed, transferred, or processed outside the Philippines where reasonably necessary to provide the Services and subject to applicable privacy requirements and appropriate safeguards. The User understands that the geographic location of infrastructure may change as CelebrateSync modifies its technology, service providers, or systems.
13. SECURITY AND FRAUD PREVENTION
The User acknowledges that CelebrateSync may process Account, device, technical, usage, authentication, Event, and security information to maintain the security and integrity of the Services. Such processing may be used to authenticate Users, protect Accounts, prevent unauthorized access, detect fraud, investigate suspicious activity, prevent abuse, protect Events, maintain system integrity, respond to security incidents, and enforce the Governing Documents. The User understands that security-related processing may continue where necessary and where supported by an applicable lawful basis even if optional consent is later withdrawn.
14. COMMUNICATIONS
By accepting this Agreement, the User acknowledges that CelebrateSync may send communications reasonably necessary to provide the Services. These may include Account notifications, security alerts, password or authentication messages, Event invitations, RSVP requests, Event updates, reminders, check-in information, service notifications, privacy notices, legal notices, and other operational communications. Optional marketing and promotional communications will be subject to applicable law and any additional consent or preference mechanism required for such communications.
15. OPTIONAL PROCESSING
The User understands that certain processing activities may be optional and may require a separate consent mechanism. These may include optional marketing communications, promotional use of photographs or videos, optional analytics, profiling, personalized recommendations, optional location functionality, or other processing that requires specific consent under applicable law. Acceptance of this Agreement does not constitute advance blanket consent to optional processing that has not been adequately disclosed to the User. Where separate consent is legally required, CelebrateSync will provide a separate and appropriate consent mechanism.
16. DATA SUBJECT RIGHTS
By accepting this Agreement, the User acknowledges that acceptance does not waive or extinguish any statutory rights under the Data Privacy Act of 2012 or other applicable law. Depending upon the circumstances, the User may have the right to be informed, access personal data, request correction, object to certain processing, withdraw consent, request erasure or blocking, exercise data portability rights where applicable, file a complaint with the National Privacy Commission, and seek other remedies available under law. The exercise of these rights remains subject to applicable legal conditions, limitations, and exceptions.
17. WITHDRAWAL OF CONSENT
Where processing is based upon consent, the User may withdraw that consent through available privacy settings, consent-management functionality, unsubscribe mechanisms, or by contacting: privacy@celebratesync.app. Withdrawal of consent does not affect the lawfulness of processing undertaken before the withdrawal. Withdrawal also does not necessarily require deletion of all information or cessation of all processing where CelebrateSync or another applicable controller has an independent lawful basis or legal obligation to retain or process the information.
18. USER RESPONSIBILITY
By accepting this Agreement, the User agrees to provide accurate information and to use the Services in accordance with the Governing Documents and applicable law. Where the User provides personal data concerning another individual, the User represents that the User has the necessary authority, permission, consent, or other lawful basis to provide such information. The User understands that CelebrateSync may rely upon the User's representation concerning the authority to submit information relating to another person, subject to applicable law and the rights of the affected individual.
19. MINORS
The User represents that the User is at least eighteen (18) years old unless access by a younger person has been expressly permitted by CelebrateSync and appropriate authorization has been obtained. The User acknowledges that information concerning minors may nevertheless be processed through Event functionality, including where minors attend Events or appear in photographs or videos. Where the User provides information concerning a minor, the User represents that the User has the necessary parental, guardian, legal, or other authority required for the applicable processing.
20. ELECTRONIC ACCEPTANCE
The User agrees that acceptance may be completed electronically through the CelebrateSync application, website, web application, Account interface, checkbox, button, or another mechanism reasonably designed to record affirmative acceptance. CelebrateSync may maintain records of the User's acceptance, including the User or Account identifier, applicable version of the Governing Documents, date and time of acceptance, acceptance mechanism, and other technical information reasonably necessary to demonstrate the existence and timing of the User's acceptance. Electronic acceptance shall have the same intended effect as a written acknowledgment to the extent permitted by applicable law.
21. VERSION OF THE AGREEMENT
The User's acceptance applies to the version of the Governing Documents presented to the User at the time of acceptance. CelebrateSync may update the Governing Documents from time to time. Where an amendment materially affects the User's rights, obligations, or privacy expectations and applicable law requires renewed acceptance or consent, CelebrateSync will provide the appropriate mechanism. Continued use of the Services will not automatically be treated as renewed consent where applicable law requires affirmative consent.
22. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without prejudice to mandatory rights and remedies available to data subjects under applicable law. Nothing in this Agreement shall be interpreted as waiving a right that cannot legally be waived.
